The firm’s annual seminars in Asia took place in Shanghai on 20th March and Hong Kong on 22nd March with Xavier Le Sourne and Charlotte Chen (from the Hong Kong office) together with Gast Juncker, Katia Panichi, Jean-Luc Fisch (from the Luxembourg office). They provided insights and solutions for asset managers, GPs and corporate entities to develop or further expand their overseas activities by using Luxembourg vehicles.
Each seminar aimed at exploring (i) current trends in public funds, including latest ESG developments, CSSF regulatory practice on performance fees, AML, MRF between Luxembourg and Hong Kong, selected Brexit impacts on Luxembourg fund structures as well as (ii) the regime of private funds including advice on the set up of Luxembourg GP/LP structures, access and use of AIFMD marketing passport, solution to implement tax efficient and BEPS compliant structuration of underlying investments and existing financing solutions during the life of the fund.
External speakers in Shanghai Harry Wang (from Lakala Payment Co.) explained Lakala’s choice to set up the Group’s headquarter in Luxembourg so as to expand in Europe and Guo Yongmao (from Haiwen & Partners Law Firm) provided insights on the exempted tax treatment by Chinese authorities in case of indirect transfer of ownership of a Chinese established private company with a Luxembourg fund as beneficial owner.
External speakers in Hong Kong Bing Li (from ICBC Asset Management Global Company Limited) and Jürg Niederberger (from Silverhorn Investment Advisors Ltd) participated in the seminar, providing their view respectively on key features of Luxembourg supervised and unsupervised investment funds. They also focused on the set-up of Luxembourg funds which offer a strong marketability of GPs’ products within the European Union.
